さて今回も

請求項の表現を理解していきます。

請求項全体は、

以下の通りです。

【請求項１】
  基地局と無線回線を通じて通信を行う通信手段と、
  契約事業者情報、端末情報、電話番号情報、ホームネットワーク情報、およびホーム国情報のうち、少なくともいずれか１つの情報が記録される第１の情報記録手段と、
  契約事業者情報、端末情報、電話番号情報、ホームネットワーク情報、およびホーム国情報のうち、前記第１の情報記録手段とは異なる少なくともいずれか１つの情報が記録される第２の情報記録手段と、

簡単にまとめると


「～手段」と「～手段」とを

備えることを特徴とする携帯端末。


という発明です。


ここで表現として


注目したいのが、


「～を備えることを特徴とする携帯端末」


という箇所です。


新規の発明は従来の発明にはない


新規性を備えておかなければ、


特許とは認められません。


平たく言えば、差別化


ですね。


その差別化を表すのに、


「～を特徴とする」


ということばが使われています。


よくよく考えれば、


新しい発明はすべて


他にない特徴があるからこそ


新発明なのですが、


そこは日本語として


読む場合の安心感というか


技術文書としての


権威を保つ必要もあるので、


どうしてもこのような


表現になるのかもしれませんね。

1.
